1. About these terms
These Terms of Use ("Terms") apply to the BrainScale.net website, its sub-domains, its mobile apps and its community forum (together, the "Services"). "BrainScale.net", "we" and "us" mean the operator of the Services. By using the Services, with or without an account, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.
2. Who we are
BrainScale.net is run by an independent developer. You can reach us at support AT brainscale.net or through the contact form.
3. Age and accounts
You must be at least 13 years old to create an account. If you are under 18, or under the age of majority where you live, a parent or guardian must agree to these Terms for you.
You can use most exercises without an account. If you create one, give us accurate information and keep your password safe. You are responsible for what happens under your account. Tell us right away if you think someone else is using it.
4. Health and results disclaimer
BrainScale.net offers brain training exercises and games for general, non-medical purposes. It is not a medical service or medical device, and it does not diagnose, treat, cure or prevent any disease or condition. Nothing on the Services is medical, psychological or professional advice. If you have health concerns, talk to a qualified professional.
Results differ from person to person. We do not promise that training will improve your memory, intelligence, attention or any other ability, in or outside the exercises. Statements from users show their own experience and are not typical results. Scientific research mentioned on the Services is for general information only.
Stop using the Services if you feel unwell, for example eye strain, headache or dizziness. If you have epilepsy or sensitivity to flashing images, ask a doctor before using fast visual exercises.
5. Purchases and prices
All purchases are one-time payments. Nothing renews automatically, and we never charge you again without a new purchase. A monthly or yearly plan gives access for that period and then simply ends.
Payments are processed by our online reseller FastSpring, which acts as the merchant of record for your order. FastSpring handles payment, taxes and invoices, and its own terms also apply to your payment. We may use other payment providers, such as PayPal, in some cases.
Prices shown include or state any taxes that apply. We may change prices at any time for everyone. A price change never affects a purchase you have already made.
6. Premium plans
BrainScale Premium gives unlimited access to the brain training exercises. It is available as a monthly, yearly or lifetime plan.
Lifetime plan. "Lifetime" means for as long as BrainScale.net operates the Services. It is not tied to your lifetime or to a fixed number of years. If we ever decide to close the Services, we will try to give at least 30 days' notice on the site, and lifetime access ends when the Services close. By buying a lifetime plan you accept this. If you do not agree, please do not buy it.
The lifetime plan covers the main exercises and features of the Services. Some future features may depend on paid outside services that cost us money every time they are used, for example AI features. Such features may need extra payment or usage limits, even for lifetime members. New large products added to BrainScale.net may also be sold separately.
All plans are personal and are tied to the account that bought them. You may not share, sell or transfer them. If you do, we may close the account without a refund.
7. Cryptogram plans
A separate Cryptogram plan (monthly or yearly) unlocks unlimited access to the Cryptogram (Letter Coding) game only. It does not include any other exercise or feature, such as Dual N-Back or Mental Math. BrainScale Premium already includes the Cryptogram game, so Premium members do not need a separate Cryptogram plan.
8. Refunds
Refunds are covered by our Refund Policy. This does not limit any rights you have under consumer law where you live.
9. Your content
If you post content on the Services, for example on the forum, it stays yours. You give us a free, worldwide, non-exclusive license to host, show and share it as part of the Services. You are responsible for what you post and must have the right to post it. We may remove content that breaks these Terms or that we consider harmful.
If you send us feedback or ideas, we may use them freely, without any obligation to you.

The Services and their content, including exercises, texts, graphics, logos and code, belong to BrainScale.net or its licensors and are protected by law. We give you a personal, non-exclusive, non-transferable right to use the Services for your own non-commercial use, under these Terms.
If you believe something on the Services infringes your copyright, email support AT brainscale.net with the work, the page where it appears, and your contact details.

The Services may link to other websites. We are not responsible for their content, products or services.
13. Ending your account
You can delete your account at any time from your profile in the app, or by emailing support AT brainscale.net. Once deleted, your account and training history cannot be restored.
We may suspend or close an account that breaks these Terms, is used for fraud, or harms the Services or other users. In those cases we may keep data we need for legal or security reasons, as described in our Privacy Policy.
14. Changes to the Services and these Terms
We keep improving the Services, so features may change, be added or be removed. We may update these Terms from time to time and will change the date at the top when we do. For important changes, we will try to notify users on the site or by email. If you keep using the Services after a change, you accept the new Terms.
15. Disclaimers
The Services are provided "as is" and "as available", without any warranty of any kind, to the fullest extent the law allows. We do not promise that the Services will always be available, error-free or secure, or that they will meet your needs or give any specific result.
16. Limitation of liability
To the fullest extent the law allows, BrainScale.net is not liable for any indirect, incidental, special or consequential damages, including lost profits, lost data or service interruption, arising from your use of the Services or your inability to use them. Our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim, or 100 U.S. dollars, whichever is higher. Some countries do not allow these limits, so they may not fully apply to you.

You agree to cover BrainScale.net against claims, losses and costs, including reasonable legal fees, caused by content you post, your misuse of the Services, or your breach of these Terms.
18. General
These Terms, together with the Privacy Policy, Cookie Policy and Refund Policy, are the whole agreement between you and BrainScale.net about the Services. If a court finds any part of these Terms invalid, the rest stays in force. If we do not enforce a right, we have not given it up. You may not transfer these Terms to someone else. We may transfer them, for example if the Services get a new owner. We may send you notices by email or by posting them on the Services.
